Sales and Cancellation/Return Conditions

 

1. Purpose:

The purpose of this document is to establish the General Conditions for Sale, Repair, and Returns for the web sales application JCM TECH-Store.

 

2. Identification of the parties:

The general conditions for sale described below (hereinafter, General Sales Conditions) exclusively govern the contractual relationship between all users of the web sales application JCM TECH-Store (hereinafter, "User" or "You") and the vendor, which is JCM TECHNOLOGIES (hereinafter, JCM TECH or the Owner), a company domiciled at Carrer Costa d’en Paratge, 6B, 08500 Vic (Barcelona), Spain.

 

3. Placing your order:

         It is a mandatory requirement that you be of legal age to be able to make a purchase on the web sales application JCM TECH-Store.

         It is a mandatory requirement that, when you register, you at least provide a mobile or landline telephone number and an email address to contact you with any issues related to your purchase.

         The contact methods we will use to send you notifications about your order will mainly be email, although on occasion we may also use the telephone or a physical post address, that you have provided before completing your registration on our web application JCM TECH-Store in order to be able to purchase.

         When the order is accepted, you will be sent an email to the address you provided beforehand in your user account with our acceptance, issuing an Order Confirmation. This Order Confirmation shall be effective once sent. If, on the other hand, we are unable to accept your Order, we shall contact you by email, telephone, or post.

         In the event that payment was made correctly, you will receive Confirmation of this in your email.


  

 

4. Availability.

JCM TECH-Store shall keep all products offered through the online shop in stock to send the order as quickly as possible and by the delivery deadlines set forth on the website. If we have run out of a product's stock, or the stock is insufficient to complete the order for any reason, we will contact you to share the new delivery timeframe or replacement products you may be interested in to find the best solution for both parties. If you do not wish to order the replacement products and the delivery deadline is inadequate, we will refund all money you may have paid.

 

5. Delivery

JCM TECH ships with leading messenger companies in the industry.

Products are shipped with absolute protection so that you receive them in perfect condition at the delivery address you provide on the order form.

You may request that the items be delivered to a different address and to a physical person other than the person signing the order, provided that the delivery address is located in Spain.

The moment that the order leaves JCM TECH's warehouse, you will receive an email with all the information on your shipment so that you can track its location at all times. Moreover, you will be given the telephone number of the transport company shipping the material so that you may contact them. The transport company has a customer service department that will help you with any questions you may have about the shipment.

Orders are delivered during normal business hours and are not delivered to post office boxes.

The merchandise will be delivered to the address you have provided. If the recipient is not there at the time of delivery, a note will be left with instructions on how to schedule a new delivery time.

JCM TECH reserves the right to modify the type of shipment and the company that carries out the shipment, regardless of provisions in this document and provided it does not clearly cause harm to the customer. In general, when the order's weight or size exceed maximum limits established by the regular transporter, we will contact you to inform you of the transporter we will use and specific delivery deadlines in this case.

Fees from shipping purchased items will be shown at the final moment of purchase and shall depend on the selected shipping option and destination. These conditions may be amended at any time with no prior notice. Orders that are already underway shall not be affected by amendments to conditions.

For the purposes of these Conditions, the "delivery" has been completed or the product(s) has/have been "delivered" when you sign off on their reception at the agreed-upon address.


5.1 Delivery deadlines

Deadlines for delivery depend on the shipping method selected by the user. The deadline shall be confirmed via email when the product leaves JCM's warehouse and the transport company has it in its possession. If these conditions need to be amended because of the special nature of the order, we will contact you to report specific deadlines.

Deadlines are estimates. For this reason, they may vary due to logistics or force majeure.

If, for any reason, we cannot meet the estimated delivery date, you will be informed and we will give you the option to move forward with the purchase, setting a new delivery date, or to cancel the purchase with a full refund on the price paid.

5.2 Impossible delivery:

We reserve the right to withdraw any product from our application at any time and/or to remove or modify any of the application's material or content. Although we will do everything possible to always process all orders, there may be exceptional circumstances that force us to refuse to process an order after having sent the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion.

We shall not be held liable to you or any other third party for withdrawing any product from our sales application JCM TECH-Store, regardless of whether said product was sold, for removing or modifying any material or content on our application, or for refusing to process an order after sending an Order Confirmation.

If this situation were to occur, we will contact you to find the best solution for both parties.

 

6. Prices

Prices in the JCM STORE sales application include VAT, which is applicable the day of the order, but exclude shipping costs, which shall be added to the price of the products when you pay for the purchase. Shipping costs shall be clearly marked apart from the product price.

The price of the products is the price on the JCM TECH-Store sales application. The price must be totally paid when placing the order.

JCM TECH reserves the right to modify the sales prices on the JCM TECH-Store sales application at any time, but items shall be invoiced based on the rates in force when the order is registered, subject to availability on that date.

 

7. Payment

You may pay for your orders with the following methods:

Payment with credit or debit card. We reserve the right to NOT accept certain payments with certain credit cards.

Payment with PayPal account.

 

JCM TECH reserves the right to change payment methods. It may create new ones or eliminate ones in existence, and the user/customer of the JCM TECH-Store sales application may not file any claims on these grounds. Notwithstanding, if the change in payment method affects an order that has already been placed, the JCM TECH-Store sales application will contact the customer to inform them of this change and offer them the option to cancel the order if they so wish.

7.1 Payment with credit/debit card:

The payment is made ONLINE, meaning in real time, through the corresponding financial institution's Redsys payment gateway, once it is confirmed that the information is correct.

In order to provide the utmost security to the payment system, the JCM TECH-Store sales application uses secure payment systems from leading financial institutions in e-commerce with their own SSL certificate.

In this regard, the confidential payment data are directly sent and encrypted (SSL) to the pertinent financial institution. The SSL encryption system that we use provides total security when sending data online. Your data are entirely confidential and protected.

Credit card data are not stored in any of JCM TECH's databases; they are only used at the virtual POS (Point Of Sale) of our financial institution, through their Secure Payment Gateway.

Credit cards are subject to verifications and authorizations from the institution that issues them, but if this institution does not authorise payment, the sale cannot be completed.

JCM TECH reserves the right to verify personal data provided by the customer and to take measures it deems suitable (including cancelling the order) so that the purchased merchandise is delivered according to the data on the order.

 

8. Return policy

If, when the product is delivered, you consider that it does not match what you have purchased, you may request that the product be returned through your user account on the webpage by following these steps:

  •       Go to the History and my orders section

  •       Click the Information option

  •       Select the product and amount

  •       Write the reason for the return

  •       Click the Request Return button.

 

In some cases, JCM may request that you send photographs of issues you have detected.

 

Once notification has been received, and if the return request is accepted, a document will be activated to print from the list of returns in your account, so you can have this document on hand when arranging the date and time with the transporter to collect the package.

The transport company will ask you for information about the document to process pick-up.

Once processed, you must print it and put it inside the box along with the product.

The device must be returned in its original packaging, in addition to instructions, documentation, and wrappings that it may come with.

Once we receive the returned merchandise, we will examine the returned product and send you an email within 14 business days after receiving the merchandise to inform you whether we will issue a refund or replace the merchandise (if applicable). The item will be refunded or replaced within 30 days after the date that the return or replacement of the defective item is confirmed.

In the event of a refund, the client may choose between a refund invoice or a discount coupon for future purchases.

If the product or products cannot be replaced, the amounts paid for the products shall be returned if a fault or defect truly exists. The amounts paid shall be refunded in full, including delivery expenses to deliver the item.

Partial returns and cancellations shall lead to partial refunds of the total amount paid for the entire order. Transport, refund, and gift-wrapping expenses shall not be returned in the event of a partial return.

The return shall be made to the same credit card or PayPal account used to pay for the purchase.

Exempt are rights recognised by applicable and current law.

 

9. Warranty for purchased products

Pursuant to Royal Legislative Decree 1/2007 of 16 November, approving the restated text of the General Law for the Defence of Consumers and Users, JCM TECH shall answer for non-conformity claims filed within five years after delivery of all the products on the webpage, except for those when this is clearly specified otherwise in the product's description.

If a manufacturing defect, JCM TECH shall be held liable for return costs, as well as expenses related to labour and materials.

The item to be returned must be properly packaged for return. The packaging must be in perfect condition and all original accessories and instructions must be kept to conduct the return.

We recommend that the purchaser read the instructions to properly use and install the product, as well as warrantee documentation included by manufacturers.

The warrantee shall not longer be valid in the event of defects or damage caused by outside factors or accidents, especially electrical accidents, wear, and installation and use not compliant with the product's instructions.

The warrantee also excludes products that have been modified or repaired by the client or anyone else not authorised by the supplier.

10. Liability and exemption from liability

The photographs and texts shown for the products are merely informative in nature.

If the user already has a JCM TECH product that was purchased before JCM TECH-Store began operation, the devices in use may not be compatible with those sold through the JCM TECH-Store online shop. In this regard, JCM TECH provides adequate texts so that the customer knows whether the devices they already have are compatible with the ones they are going to purchase.

If the customer contacts JCM TECH by any means of communication (chat, telephone, email, or contact form), JCM TECH will help them to find the best solution to meet their needs but shall not be held liable for any compensation the customer may demand if they have purchased devices that are not compatible with the ones they already had in operation.

JCM TECH's shall not be held liable in relation to any product purchased through the JCM TECH-Store sales application for simple errors or omissions that may occur.

JCM TECH shall not be held liable for damages that may be caused by products if the customers modify them or operate them inappropriately.

JCM TECH shall not be held liable by a customer or third party for:

  •     Indirect damages

  •     Operational losses

  •      Loss of profit

Damages occurring by any means, even if said damage, loss, or harm was foreseeable by JCM TECH or JCM TECH was made aware of it beforehand.

JCM TECH shall not be held liable for failure to comply with the contract entered into in the event of force majeure, interruption of activity, or total or partial strike, or especially interruption of postal services and means of transport or communications, flooding, or fire.

JCM TECH's liability shall be no greater than the amount equal to the sums paid for the sale from whence said liability arises, regardless of the cause or form of action in question.

Provisions in this clause shall not affect your legally recognised rights as a consumer, nor your right to withdraw from the contract.

In the event of dispute, the client may first address JCM TECH to reach a friendly resolution.

These General Conditions for sale are governed by Spanish Law. At their choice, the parties submit to the courts and tribunals of Vic (Barcelona) to resolve conflicts and waive any other jurisdiction.
